Polyguard Window Well Cover Warranty
Polyguard Covers, Inc. (“Polyguard”) warrants Polyguard Window Well Covers (“Polyguard Covers”) to the original purchaser for lifetime against breakage due to defects in materials or workmanship. Polyguard Covers are warranted to the original purchaser against discoloring due to defects in materials or workmanship for a period of ten (10) years from the date of purchase for Polyguard Covers with a clear finish, provided that the Polyguard Covers are used for their intended purposes only, and are maintained by the purchaser in accordance with the instructions provided with each Polyguard Cover. Polyguard Covers, Inc. (“Polyguard”) warrants Metalguard Window Well Covers (“Metalguard Covers”) to the original purchaser for 1 year against breakage due to defects in materials or workmanship. Metalguard Covers are warranted to the original purchaser against powder coating finish discoloring, chipping, scratching, or metal rusting due to defects in materials or workmanship for a period of one (1) year from the date of purchase provided in each case that the Metalguard Covers are used for their intended purposes only, and are maintained by the purchaser in accordance with the instructions provided with each Metalguard Cover. Polyguard Covers and Metalguard are not designed to be structural, and are not intended to be walked, stood or sat upon, or to support people, pets, furniture or other household items. Polyguard Covers Inc. advertises the covers supporting up to 350 lbs. as a demonstration of the strength of the material only.
The Polyguard Covers and Metalguard Covers, when sold with the optional security kit, are designed to make unauthorized entry more difficult, but are not designed, nor are they warranted, to be burglar-proof. The purchaser is advised to use other home security devices, such as window locks, to provide desired security.
Polyguard and Metalguard Covers are not warranted against damage to the covers or personal property that might be caused by acts of God or Mother Nature such as but not limited to storms, snow, rain and high wind. Optional security kits are available and recommended to prevent covers from being lifted off the window well due to high winds.
Anything herein to the contrary notwithstanding, this warranty shall not apply to a Polyguard Cover or Metalguard Cover or any part thereof which has been subjected to accident, negligence, alteration, abuse, or misuse. Without limiting the generality of the foregoing, the application of weight or force to a Cover shall be deemed to be misuse per se. Polyguard’s obligation under this Warranty shall be limited to the repair or replacement of any Cover which may be found to be defective under normal intended home use within the applicable warranty period as stated above. This warranty is in expressly in lieu of any other warranties expressed or implied, including the warranties of merchantability and fitness for use and of all other obligations and liabilities on the part of Polyguard. Polyguard neither assumes nor authorizes any other person to assume for it, any other liability in connection with the sale of the Covers. Polyguard makes no warranty whatsoever in respect to accessories or parts not manufactured by Polyguard. All such parts which are not manufactured by Polyguard carry only the warranty of the manufacturer thereof, and the purchaser should contact the manufacturer with respect to a defective part not warranted by Polyguard. The term “Polyguard Covers” or “Metalguard Covers” as used in this warranty shall be deemed to include the clips, security kits and escape ladders sold by Polyguard. The terms “purchaser” and “original purchaser” as used in this warranty shall be deemed to mean the person or persons to whom the Polyguard Covers or Metalguard Covers are originally sold. This warranty shall apply if and only if the Polyguard Covers or Metalguard Covers have been properly installed, and maintained by the purchaser, and if a defective Cover is returned by the purchaser with proof of purchase to Polyguard for appropriate repair or replacement.
Polyguard warrants all installation of Polyguard products if installed by Polyguard’s authorized installer. For one year after installation is complete, upon the request of the customer, Polyguard will reinstall any defectively installed Polyguard product free of charge, provided that the product has been properly maintained and has not been misused by the customer.
Maintenance & Cleaning
Check cover(s) regularly to see that it has not shifted or moved from its properly installed position. Clean using only a non-abrasive cloth with water or common cleaning solution such as: 409 or Windex. Polyguard Covers and Metalguard Covers should be inspected and cleaned regularly. Inspection should include checking to see that the cover is still in its properly installed position and adjusted if necessary. As well as, inspecting the cover to see if any parts are broken or missing. Any broken or missing parts should be repaired or replaced immediately. Polyguard Covers should be kept clean to eliminate the buildup of hard water spots (if applicable). Hard water deposits can cause discoloration that is not covered under the warranty. Buildup of hard water deposits would suggest that the cover was not cleaned and maintained and therefore voids any and all warranties.
Read the following terms to determine which payment term applies to your order. Payment (Cash, Check, MC/VISA/DISCOVER.) Final Payment due 10 days from the date of installation. Deposit of 50% is required on all orders. Payment in full (100%) is required at the time of approval for non-owner occupied orders, third party orders, highly custom orders, and orders placed during the off season. Past due accounts will result in the forfeit of any special pricing or discounts. Past due accounts are subject to $10 monthly late fee and 18% annual interest. As part of the collection process customer authorizes Polyguard Covers Inc. to remove and recover any products that have not been paid in full and a charge of $25 per cover will be charged for re-installation. Return Check Fee: $25. Prices are subject to change without notice. Templates and measurements are discarded after 14 days. Any order confirmation received after the initial 14 day period will result in an additional re-measuring fee of $25.
